1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of DocuMind AI (the “Service”), operated by Archana Info Solutions Pvt Ltd (“we”, “us”, or “DocuMind”). By accessing or using DocuMind AI, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not use the Service.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use DocuMind AI. By using the Service, you represent and warrant that you meet these requirements.
3. Account Registration
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities that occur under your account
You are responsible for all activity on your account, whether or not authorized by you.
4. Subscription Plans & Billing
4.1 Plans
DocuMind AI offers multiple subscription tiers: Starter (free), Professional, and Enterprise. Each plan has specific features, usage limits, and pricing as described on our Pricing page.
4.2 Billing
Paid plans are billed monthly or annually in advance. By subscribing, you authorize us to charge your payment method for the subscription fee and any applicable taxes on a recurring basis until you cancel.
4.3 Free Trial
We may offer a free trial of paid plans. At the end of the trial, your account will automatically revert to the free Starter plan unless you upgrade. No charges will be made without your explicit consent.
4.4 Refunds
Subscription fees are generally non-refundable. However, we may offer prorated refunds at our discretion for service disruptions or billing errors.
4.5 Price Changes
We reserve the right to modify our pricing. Price changes will be communicated at least 30 days in advance and will apply to new billing cycles only.
5. Acceptable Use
You agree not to use DocuMind AI to:
- Violate any applicable laws or regulations
- Upload content that infringes on intellectual property rights
- Upload malicious software, viruses, or harmful code
- Attempt to gain unauthorized access to our systems or other accounts
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to send spam, phishing messages, or unsolicited communications
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell, sublicense, or redistribute the Service without written permission
- Use the Service to process illegal content or commit fraud
6. Your Content
6.1 Ownership
You retain all ownership rights to the documents and content you upload to DocuMind AI (“Your Content”). We do not claim ownership of Your Content.
6.2 License to Us
By uploading content, you grant DocuMind a limited, non-exclusive, worldwide license to store, process, analyse, and display Your Content solely to provide the Service to you.
6.3 Responsibility
You are solely responsible for Your Content and warrant that you have all necessary rights to upload it. You must not upload content that is unlawful, harmful, or infringes on third-party rights.
7. Intellectual Property
The Service, including all software, designs, logos, and content (excluding Your Content), is the property of Archana Info Solutions Pvt Ltd and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our written permission.
8. AI-Generated Output
DocuMind AI uses large language models to generate analysis, summaries, extractions, and other outputs based on Your Content. You acknowledge that:
- AI-generated output may contain inaccuracies or errors
- You should review and verify any AI-generated content before relying on it for critical decisions
- DocuMind is not liable for decisions made based solely on AI output
- AI output should not substitute for professional legal, financial, medical, or other expert advice
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance or experience unexpected outages. Professional and Enterprise plans include SLA guarantees as specified in your plan.
10. Termination
10.1 By You
You may cancel your account at any time through the Settings page. Upon cancellation, your paid features will remain active until the end of your current billing period.
10.2 By Us
We may suspend or terminate your account without notice if you:
- Breach these Terms
- Engage in fraudulent or illegal activity
- Fail to pay fees when due
- Use the Service in a way that harms other users or our infrastructure
10.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. We will provide a 30-day window to export Your Content, after which we may delete it in accordance with our retention policies.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or continuously available.
12. Limitation of Liability
To the maximum extent permitted by law, DocuMind and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service.
Our total liability for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless DocuMind, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana, India.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use of DocuMind AI after changes become effective constitutes acceptance of the updated Terms.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DocuMind regarding the Service. They supersede any prior agreements or understandings.
