1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of EduAssess AI (the “Service”), operated by Archana Info Solutions Pvt Ltd (“we”, “us”, or “EduAssess”). By accessing or using EduAssess AI, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not use the Service.
2. Eligibility
EduAssess AI is intended for use by educational institutions and their authorised staff, and by enrolled students and their parents/guardians. Account holders (administrators, teachers) must be at least 18 years old and have the legal authority to enter into a binding contract on behalf of the institution. Students under 18 may use the Service only through an institutional account with verifiable parental consent.
3. Account Registration
When you create an institutional account, you agree to:
- Provide accurate, current, and complete information about the institution
- Maintain and promptly update account information
- Keep passwords secure and confidential
- Notify us immediately of any unauthorised access
- Obtain verifiable parental consent before enrolling students under 18
- Accept responsibility for all activities that occur under your account and sub-accounts (teachers, students, parents)
The institution is responsible for all activity on its account and for ensuring that its staff, students, and parents comply with these Terms.
4. Subscription Plans & Billing
4.1 Plans
EduAssess AI offers multiple subscription tiers: Free, Starter, Professional, School, and Enterprise. Each plan has specific features, usage limits (students, teachers, exams, AI credits, storage), and pricing as described on our Pricing page.
4.2 Billing
Paid plans are billed monthly or annually in advance in Indian Rupees (INR). By subscribing, you authorise us to charge your payment method for the subscription fee plus applicable GST and any other taxes on a recurring basis until you cancel. We use Razorpay and other PCI-compliant payment processors.
4.3 Free Trial
We may offer a free trial of paid plans. At the end of the trial, your account will automatically revert to the Free plan unless you upgrade. No charges will be made without your explicit consent.
4.4 Refunds
Subscription fees are generally non-refundable. However, we may offer prorated refunds at our discretion for extended service disruptions, billing errors, or as required by Indian consumer protection laws.
4.5 Price Changes
We reserve the right to modify our pricing. Price changes will be communicated at least 30 days in advance and will apply to new billing cycles only. Mid-academic-year price increases will not be applied to existing annual subscriptions.
5. Acceptable Use
You agree not to use EduAssess AI to:
- Violate any applicable laws or regulations, including the DPDP Act, 2023
- Upload content that infringes on intellectual property rights of textbook publishers or authors without permission
- Upload content that is obscene, defamatory, discriminatory, or harmful to children
- Upload malicious software, viruses, or harmful code
- Attempt to gain unauthorised access to other institutions’ data or our systems
- Use the Service to facilitate or encourage cheating, plagiarism, or academic dishonesty
- Bypass or disable proctoring, anti-cheating, or security features
- Interfere with or disrupt the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell, sublicense, or redistribute the Service without written permission
- Use the Service for any purpose other than education and assessment
6. Your Content & Student Data
6.1 Ownership
You retain all ownership rights to the syllabi, question papers, student records, and other content you upload to EduAssess AI (“Your Content”). We do not claim ownership of Your Content. Student data remains the property of the institution and the students (through their parents/guardians).
6.2 License to Us
By uploading content, you grant EduAssess a limited, non-exclusive, non-transferable, worldwide license to store, process, analyse, and display Your Content solely to provide the Service to you and your authorised users.
6.3 Responsibility
You are solely responsible for Your Content and warrant that you have all necessary rights and consents (including parental consent for minors) to upload and process it. You must not upload content that is unlawful, harmful, or infringes on third-party rights.
6.4 Data Processor Role
Under India’s DPDP Act, 2023, the institution acts as the Data Fiduciary and EduAssess acts as the Data Processor when handling student personal data. A separate Data Processing Agreement (DPA) governs this relationship and is available on request.
7. Intellectual Property
The Service, including all software, designs, logos, AI models, question templates, rubrics, and content (excluding Your Content), is the property of Archana Info Solutions Pvt Ltd and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our written permission.
8. AI-Generated Output
EduAssess AI uses large language models to generate questions, evaluate answers, predict performance, and produce remedial plans. You acknowledge that:
- AI-generated questions may require teacher review for curriculum alignment and difficulty calibration
- AI-generated evaluation for subjective answers should be reviewed by teachers before finalising grades
- Performance predictions and remedial plans are probabilistic suggestions, not guarantees
- EduAssess is not liable for academic decisions made solely on AI output without teacher review
- AI output should support, not replace, qualified teacher judgement
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance (typically during non-school hours) or experience unexpected outages. Professional, School, and Enterprise plans include SLA guarantees as specified in your plan. During board exam seasons, we prioritise system stability and may restrict certain non-critical features.
10. Termination
10.1 By You
You may cancel your institutional account at any time through the Settings page or by written notice. Upon cancellation, your paid features will remain active until the end of your current billing period. Annual subscriptions may be cancelled but are generally non-refundable as noted in Section 4.4.
10.2 By Us
We may suspend or terminate your account without notice if you:
- Breach these Terms
- Engage in fraudulent, illegal, or harmful activity
- Fail to pay fees when due (after grace period and reminders)
- Use the Service in a way that endangers student safety or data
- Violate child protection laws or DPDP Act provisions
10.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. We will provide a 90-day window to export student records and historical data, after which we may delete it in accordance with our retention policies (Section 9 of the Privacy Policy).
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or continuously available, or that AI output will be fully accurate.
12. Limitation of Liability
To the maximum extent permitted by law, EduAssess and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, academic opportunity, or goodwill, arising out of or related to your use of the Service.
Our total liability for any claim arising from or related to the Service is limited to the amount the institution paid us in the 12 months preceding the claim.
13. Indemnification
The institution agrees to indemnify and hold harmless EduAssess, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from its use of the Service, its violation of these Terms, its failure to obtain proper parental consent, or its infringement of any third-party rights.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023. Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana, India.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered institutions at least 30 days in advance. Your continued use of EduAssess AI after changes become effective constitutes acceptance of the updated Terms.
16. Entire Agreement
These Terms, together with our Privacy Policy and any applicable Data Processing Agreement, constitute the entire agreement between you and EduAssess regarding the Service. They supersede any prior agreements or understandings.
